The licensor does not take any responsibility or liability for any accidents resulting in death, injury, or illness. Loss or damage to property (including motor vehicles) or personal effects sustained by yourselves or any other visitors to the holiday villa during your stay regardless of how they may have occurred.
Please read these conditions carefully prior to making a booking. They are limited to our property and do not apply to terms and conditions in relation to any other person or company whose services you or your party use on any holiday.
Booking
Following receipt of the completed booking form and the appropriate payment, confirmations of reservations will be sent out as soon as possible.
Our Booking Terms and Conditions and your Booking Form contain all provisions of your booking with Villa Joy. This applies equally to the Contractor and to all guests included in the Booking Form as ‘Guests’.
Receipt of this Booking Form constitutes our conditional offer for the rental of the Property and for any additional services that you have requested. This offer is subject to our receipt of the Booking Form, duly completed and signed by you within 48 hours from the e-mail of the Booking Documents to you.
This booking pertains to accommodation in a furnished luxury property with daily cleaning service and change of linen twice a week.
Damages / Security Deposit
The Property shall be checked prior to and after the Rental Period. Guests shall be held liable for any proven damages or losses caused to the Property and its contents. We recommend that you ensure that guests have an insurance policy that will cover accidental damage to the Property and its contents.
Security Deposit shall be returned to guests at the latest within 7 working days from the end of the Rental Period. Potential proven damages, including any loss or damage to the property or its contents, late departure from the property, non-return of keys, excessive cleaning costs, misuse of telephone, and any resultant costs will be deducted from the Security Deposit. In the exceptional case where the cost of repairing/replacing any proven damages exceeds the Security Deposit, you accept to cover the additional cost within 7 days of your notification. In the exceptional case the cost of repairing/replacing any proven damages exceeds the security deposit an agent will assist the Licenser or to redeem any such costs from the Guests.
Changes
Should you need to make changes to your rental once the booking is confirmed, we will do our best to accommodate you. However, any amendments may result in an amendment fee, and or cancellation charges being incurred.
Cancellations
All cancellations must be made in writing and will be subject to the below listed charges. If the client does not pay the balance at the prescribed time, we reserve the right to cancel the booking. In this event, the deposit will be forfeited.
The following cancellation policy shall apply, in the event that a replacement booking does not materialize:
- Cancellation by you more than 12 weeks prior to the first day of Rental: The deposit equal to 30% of the total reservation amount shall not be refunded.
- Cancellation by you less than 12 weeks prior to first day of Rental: No refund will be made
Cancellation by Owner
In the unlikely event that circumstances beyond our control necessitate the cancellation of the rental arrangement, we reserve the right to cancel any bookings at any time and will only be liable to refund money already paid by the client. Every effort will be made to provide similar suitable alternative accommodation. If no acceptable alternatives can be found of a similar property, rental costs will be reimbursed. The owner will not be under any further liability to the renter.
Force Majeure
We cannot accept, be responsible for, or be liable in respect of loss, damage or changes caused by force majeure. All of the following shall be considered force majeure: threat of war, an act of terrorism, sovereign default, civil riots, industrial action, dangerous weather conditions, fire, flood, drought, unexpected shutting down of an airport or harbor, unforeseen changes to transport time schedules, or any other event which is beyond our control.
Check In/Check Out
The property is available after 3pm on the day of arrival and must be vacated by 10:30 am on the day of departure unless agreed previously with the owner. Refunds will not be given for early departures. We will not be held responsible for any items left after check-out.
Children
Children should be supervised at all times by adults, especially in the vicinity of water.
Non-Smoking / Pets Allowed
The property is a non-smoking property and pets are allowed after discussion with the owner.
Extra Persons / Events
The Tenant must honor the capacity of the property and no extra persons can be accommodated at it. No parties and loud music that will disturb the surrounding properties during the time curfews are allowed in the property.
Complaints and Problems During Your Stay
While we will do everything in our power to provide you with a trouble-free stay, a villa may present malfunctions like any other house.
Our aim to mend any problem that arises within 24 hours may not always be feasible because of the time of day or day of the week, the location of the villa, the unavailability of technicians, etc. If guests are dissatisfied with the Property or the service of a Supplier, please contact us immediately. It is a precondition for any compensation that you inform us in writing of all complaints as soon as possible and in any event not after the end of the Rental Period.
Please note that our property is located on an island with severe problems of drought. We kindly ask you to use water sparingly, especially during the summer months. Electricity and water shortages may, and do, occur in some areas and while we will do everything in our power to reestablish supply or remedy the situation, we cannot be held responsible for the inconvenience such shortages may create.
Photography
Photographs taken at our properties may not be used or sold for profit without authorization from Villa Joy Mykonos or the owner.
Security and Valuables
Any valuables left at the property are left at your own risk. Neither we nor the owner are responsible for any loss. When provided, burglar alarms must be activated, safes used, and proper care taken against theft and burglary. It is your responsibility to ensure all doors and windows are closed and locked when leaving the property, or when by the poolside/in the grounds. If theft or damage to the owner’s property occurs through negligence on your part the owner is entitled to seek compensation from you. No refund can be given should you decide to vacate the property as a consequence of a burglary unless it can be proven that the owner has failed to inform you of anti-burglary systems in the property.
Disclosure of Your Information
The information you provide to us may be accessed by or given to third parties some of whom may be located outside the European Economic Area who act for us for the purposes set out in this policy or for other purposes approved by you. Those parties process information, process credit card payments, and provide support services on our behalf. We may also pass aggregate information on the usage of our website to third parties but this will not include information that can be used to identify you.
Liability
We do not accept any liability for injury, damage, or loss caused by any reason or for any claim made as a result of this booking and/or the subsequent holiday. The renter is responsible for taking out an adequate insurance policy(ies) to cover all risks. This waiver is also applicable to people visiting the property as guests of the renter(s). All guests will be responsible for behaving in a responsible manner and in accordance with local regulations. We do not accept any responsibility for termination of travel or holiday arrangements due to guests causing distress, annoyance, damage, or danger to others and therefore will not consider any claims for compensation.
Third-Party Liability
We also do not accept any liability for injury, damage, or loss caused, or for any such claim by a third party as a consequence of actions by the renter(s) and other people occupying the property during the period of the rent. You are strongly advised to take out your own holiday travel insurance.
Waiver
A failure to exercise or delay in exercising any right or remedy in connection with this Agreement shall not constitute a waiver of that or any other right or remedy. A waiver of a breach of this Agreement shall not constitute a waiver of any other breach of this Agreement.
No Partnership / Agency
Nothing in this Agreement is intended to or shall operate to create a partnership, or to authorize a party to act as an agent for any other, and no party shall have authority to act in the name or on behalf of or otherwise to bind any other in any way (including but not limited to the making of any representation or warranty, the assumption of any obligation or liability, and the exercise of any right or power).
Severance
The invalidity or unenforceability of any provision of this Agreement shall not affect the validity and enforceability of the other provisions of this Agreement. If any provision of this Agreement becomes or is held by a court of competent jurisdiction to be invalid or unenforceable, then the Parties shall enter into good faith negotiations to substitute a valid or enforceable Clause which achieves so far as possible the objectives of the original Clause.
Counterparts
This Agreement may be executed by the Parties using separate documents in the same form, each of which shall be an original counterpart of this Agreement.
Entire Agreement
This Agreement and the documents referred to in it, including the Licence and the schedules hereto, constitute the entire agreement and understanding of the Parties relating to the subject matter of this Agreement and supersede all other agreements or arrangements between any of the Parties relating to such subject matter, which shall cease to have any further effect. Neither this Agreement nor any of its provisions may be amended, modified, changed, waived, or discharged, except in writing signed by all the Parties. Each of the Parties acknowledges and agrees that in entering into the Agreement, it has not relied on any statement, representation, warranty, understanding, undertaking, promise, or assurance of any Person (whether party to this Agreement or not) other than as expressly set out in the Agreement.
Governing Law, Jurisdiction and Service Proceedings
The validity, construction, and performance of this Agreement (and any claim, dispute, or matter arising under or in connection with it or its enforceability) and any obligations arising out of or in connection with it shall be governed by and construed in accordance with Greek Law.
The competent courts of Athens shall have exclusive jurisdiction over any claim, dispute, or matter arising under or in connection with this Agreement or its enforceability. Each Party irrevocably waives any objection which it may have now or later to proceedings being brought in the courts of Athens, Greece and any claim that proceedings have been brought in an inconvenient forum. Each party further irrevocably agrees that a judgment in any proceedings brought in the courts of Athens shall be conclusive and binding upon each party and may be enforced in the courts of any other jurisdiction, without need to commence new proceedings.
